Increasing trend of non-trustee defendants in ESOP lawsuits

Increasingly, stock sellers and others not typically named as defendants alongside employee stock ownership plan (ESOP) fiduciaries are being sued in ESOP-related litigation. Chris Nemeth and Jane Kim recently hosted a webinar for members of the National Center for Employee Ownership (NCEO) analyzing this trend. They discussed the types of claims that have recently been brought in ESOP-related litigation against sellers, corporate officers, outside investors and other non-fiduciaries and provided practical tips for protecting yourself against such lawsuits.
